1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Belaya Grusha Tourism ("we," "our," or "us") governing your use of the website belaya-grusha.com (the "Site") and the tourism services offered through the Site (collectively, the "Services").
By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Site or Services.
2. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Belaya Grusha Tourism, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:
- Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your web browser for display enhancement purposes.
- You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Bookings and Payments
All bookings made through our Site are subject to availability and acceptance.
Booking Process
By making a booking, you warrant that you have the authority to accept these Terms on behalf of all members of your party and that all such persons will comply with these Terms.
Upon receiving your booking request, we will send you a confirmation email. The contract between us is formed when we send you the confirmation email, and a binding contract exists when we have confirmed availability and received your deposit or full payment.
Prices and Payments
All prices displayed on the Site are in Australian Dollars (AUD) and include applicable taxes unless otherwise stated. Prices are subject to change without notice until your booking is confirmed.
Payment terms:
- A deposit (usually 20% of the total tour price) is required at the time of booking to secure your reservation.
- The balance of the payment must be paid at least 60 days before the departure date unless otherwise specified.
- For bookings made within 60 days of departure, full payment is required at the time of booking.
5. Cancellations and Refunds
Cancellation by You
If you need to cancel your booking, please notify us in writing as soon as possible. Cancellation fees will apply as follows:
- More than 60 days before departure: Loss of deposit
- 60-30 days before departure: 50% of total tour cost
- Less than 30 days before departure: 100% of total tour cost
We strongly recommend that you purchase travel insurance to cover cancellation fees in the event of unforeseen circumstances.
Changes by You
If you wish to make changes to your booking, we will do our best to accommodate your request, but we cannot guarantee that changes will be possible. Any changes are subject to availability and may incur additional charges.
Cancellation by Us
We reserve the right to cancel tours due to insufficient participation, unforeseen circumstances, or events beyond our control. In such cases, we will offer you either:
- A full refund of all monies paid;
- An alternative tour of comparable standard, if available; or
- A credit for future travel.
6. Prohibited Activities
You agree not to use the Site or Services for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to:
- Using the Site in any way that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.
- Using any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
- Using any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent.
- Using any device, software, or routine that interferes with the proper working of the Site.
- Introducing any viruses, Trojan horses, worms, logic bombs, or other harmful material to the Site.
- Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
- Impersonating or attempting to impersonate the Company, a Company employee, another user, or any other person or entity.
7. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BELAYA GRUSHA TOURISM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, SERVICES, OR ANY CONTENT ON THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Indemnification
You agree to defend, indemnify, and hold harmless Belaya Grusha Tourism, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or Services.
10. Term and Termination
These Terms shall remain in full force and effect while you use the Site or Services.
We may terminate or suspend your access to the Site or Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Site or Services shall be instituted exclusively in the federal courts of Australia or the courts of New South Wales, Australia. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
12. Changes to Terms
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter.
Your continued use of the Site or Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
